Inheriting a house with a mortgage: what do you need to arrange?
What would you like help with?
Detailed explanation, checklist and sources
The mortgage does not disappear when the owner dies. Whether you can keep the house depends, among other things, on the debt, any insurance payout and your financial means. First map out the entire inheritance and discuss with the bank what is possible.

Check the mortgage and insurance
Report the death to the mortgage lender. Ask about the remaining debt, monthly payments and arrangements for settlement. Term life insurance may repay part of the mortgage; ask whether there is a policy and what it covers. Also discuss how payments will be arranged while you have not yet made a choice.
Choose how to accept the inheritance
With unconditional acceptance, you may also be liable for debts with your own money. With acceptance subject to the benefit of inventory, debts are in principle paid from the inheritance, according to the settlement rules. Your private assets generally remain protected if you comply with the settlement rules. You can also renounce the inheritance. Therefore, do not already sell or distribute items without knowing what this means for your choice.
Keep the house or sell it together
Do you want to live in the house yourself? Discuss with the bank whether you can afford the mortgage and other housing costs. If there are more heirs, you must also make arrangements regarding their share. First check the will and existing rights of occupation: the home is not always freely available. In the event of a sale, the notary will assist with the certificate of inheritance and the further transfer.
Buying out the other heirs
Have the value determined and discuss how the debt and each person's inheritance share will be reflected in the distribution. The WOZ value is not automatically the agreed buyout value. A transfer within the distribution may take place through a notarial deed of distribution. Also arrange the financing and responsibility for the mortgage with the bank.
Keep inheritance tax and property value separate
For inheritance tax on a home, the starting point is generally the WOZ value, reduced by the mortgage debt. You may choose between the WOZ value for the year of death and that for the following year. Different valuation rules may apply in cases such as letting or special rights of occupation. Income tax also depends on what you do with the home.
Further points to check
If you are the sole heir and have accepted, ownership passes through succession; ask the notary to register the inheritance certificate with the Kadaster to update the registered name. Allocation to one co-heir may use a partition deed without a separate purchase contract. An existing tenant pays the heirs; provide verified payment instructions. Temporary occupation does not make a co-heir sole owner. Assess ownership, tenancy and surviving-partner rights separately, including after rejection; do not evict yourself. Ask the notary for a cost estimate and contact the Tax Administration promptly about payment options if inheritance tax cannot be funded.

For each event, note the date, what happened and where the evidence is kept. Example: 3 October — letter received — correspondence folder.
Describe the solution you would like, such as an explanation of a deduction and repayment of the outstanding amount.
For example: which document is missing, who can provide it and what should I do first?
Record the date and its source. If unknown, note this and check promptly. This tool does not calculate or monitor deadlines.

Frequently asked questions
Do I have to repay the mortgage in full immediately?
This does not automatically follow from the death. Ask the bank which arrangements apply to this mortgage and what options there are for continuation, repayment or sale.
What if the mortgage is higher than the value of the house?
Also consider the other assets and debts. Before making your choice, have it assessed whether acceptance subject to the benefit of inventory or renunciation is appropriate. A house with negative equity does not automatically mean that the entire inheritance is negative.
Can I inherit the house without the debts?
As an heir, you do not choose separately which assets and debts you accept. Acceptance subject to the benefit of inventory can protect your private assets. If the property was left to you as a legacy, have it checked whether this is with or without the mortgage debt.
What deadline applies if a co-heir has accepted subject to the benefit of inventory?
Have you not yet made a choice yourself? Then you must make your choice within three months after becoming aware of that acceptance subject to the benefit of inventory. If you do not do so, acceptance subject to the benefit of inventory also applies to you. Separate rules apply to minor heirs. Have the deadline in your situation checked.
