Detailed explanation, checklist and sources

If you usually work in the Netherlands and at least 25% in your foreign residence country, insurance is usually there. An exception may be available on application for under 50% telework. It is not automatic and does not decide tax liability.

1. What is the ordinary rule?

Normal European allocation rules resumed after 1 July 2023. Working in the Netherlands while doing 25% or more in an EU/EEA residence country or Switzerland usually means insurance there. Record all activities and countries, not just favourable home-working days.

2. What about temporary full-time foreign telework?

Temporary wholly remote work from another EU/EEA country or Switzerland can often retain Dutch insurance if shorter than 24 months. Request A 1 and check conditions. This differs from regularly splitting work between the Netherlands and your residence country.

3. When does the Framework Agreement apply?

For the Dutch exception, live abroad in a signatory country, be solely employed and telework at least 25% but under 50% in your residence country. All employers must be Netherlands-established. No other work in your residence country or any third-country work. Dutch residents apply to the employer-country institution. Check current signatories through SVB's official link.

4. Can I apply retrospectively?

Since 1 July 2024, framework applications can reach back at most three months if only Dutch social contributions were paid then, never before 1 July 2023. Without an exception application normal rules apply. The former one-year transitional window is not a current deadline.

5. What if the Framework does not fit?

Under supplementary policy SVB may seek residence-country agreement. Employees need non-Dutch EU/EEA/Swiss residence,25–under 50% telework there with no other local work, and over 50% total work in the Netherlands. Only foreign institutional consent establishes the exception. For past periods SVB cooperates only if contributions were solely Dutch, never before 1 July 2023.

6. What about self-employed supplementary policy?

Self-employed people are outside the Framework. Supplementary policy additionally requires over 50% work and the centre of activity in the Netherlands; turnover, time, services and dates matter. Combined employed/self-employed people must also work as employees in multiple states and over 50% of employed time in the Netherlands. Belgium's RSVZ does not grant exceptions for regular cross-border self-employed telework. Foreign consent remains essential.

7. How do I apply?

Complete SVB's official questionnaire; if conditions fit, print, sign and post its form. Retain application, country/hour breakdown, contributions and decision. Report changes and obtain the appropriate A 1 if needed. Assess tax, employment law and healthcare separately; insurance exemption is not general permission to work remotely.

Two days home in Belgium and three in the Netherlands: automatically Dutch insured?

No. That is around 40% in the residence country. An employee may request an exception if every condition holds; otherwise normal rules apply. Self-employed people in Belgium face the RSVZ restriction.
