A care dwelling in the garden: ownership, costs and leaving
What would you like help with?
Detailed explanation, checklist and sources
Before buying or installing a Dutch mantelzorgwoning, check planning rules, ownership and finance. Paying for the building does not always make you its owner. Plan for care ending, sale of the land and death.

1. Is this dwelling allowed here?
Identify whether you are converting a garage, installing a temporary unit or creating a permanent second home. Check both building and residential use in the current municipal plan through Omgevingsloket, and the Bbl technical rules. Exemption from permits is conditional; care needs and occupants matter. A future wish for care or a 'care dwelling' label is insufficient. Ask the municipality where uncertain.
2. Who will own it?
A building permanently attached to land generally belongs to the landowner, even if someone else paid. Calling it movable does not automatically prevent accession. If separate building ownership is needed, discuss a notarially established and registered right of superficies before installation. Long leasehold and usufruct provide different rights of use. Check the owner, existing mortgage and ranking of rights.
3. Agree occupancy and ending the arrangement
Record who may live there, including a partner, access, privacy and consequences of admission to care, death, sale or dispute. When temporary care accommodation ends, extra residential use may have to stop, a building may need to revert to another use, or a unit may need removal. A surviving partner has no automatic right to stay. Align private agreements with municipal permission; allocate deadlines, removal costs and compensation.
4. Costs and funding
Obtain current quotations for the unit, groundwork, connections, transport, permits, notary and maintenance; an indicative price is not a total budget. Record savings, loans or gifts and divide energy, maintenance, insurance and any rent. Check landowner and mortgage-lender consent first. A mortgage or municipal blijverslening is not automatically available; assess eligibility and affordability. Consider rent benefit separately.
5. Address, benefits and taxes
Ask the municipality whether a separate BAG address/house number is possible and register residents at the correct BRP address. A number alone does not establish all benefit rights; each scheme assesses actual residence and household circumstances. Request WOZ object classification and local charges. A temporary unit subject to removal may add little value; without that obligation, the effect may differ. Income tax also depends on ownership and use.
6. Prepare before committing
Gather a site drawing, care circumstances, title deed, mortgage terms, quotations and preferred exit arrangements. Check municipal feasibility, then notarial ownership/use rights and financial consequences before placing a binding order. Record which party bears each risk. A habitable building is not automatically authorised or tax-favoured. Expected future relaxations for family or care dwellings are not current permission; recheck rules when carrying out the project.

Am I the owner if I pay for a dwelling in my child's garden?
Not necessarily. Permanent attachment can make the building the landowner's property. Before payment and installation, check whether superficies or another suitable right is needed. A family agreement alone does not prevent accession.
