Checking an employment contract: what should you ask before signing?

Detailed explanation, checklist and sources

Compare the full offer with what was discussed: duration, hours, pay, probation and leaving arrangements. Completing a checklist does not certify validity. This preparation concerns work in the Netherlands, not an individual legal assessment.

1. Collect the complete offer

Compare the draft, offer email and referenced attachments. Request the relevant staff handbook and applicable collective agreement. Check the employer, role and workplace. Naming a collective agreement alone does not establish which provisions apply to your work.

2. Separate contract duration from leaving early

Note the start date and, for fixed-term work, end date or defined ending event. Separately check written early-termination permission and the notice period. An end date is not a right to leave earlier. Include previous contracts when renewing; use our existing notice-period guide for the specific rules.

3. Compare hours, pay and availability

Record guaranteed hours, extra hours, scheduling arrangements and gross hourly or monthly pay. Ask whether holiday allowance and supplements are separate and how overtime, travel and bonuses work. Zero-hours and min-max contracts also require checking calls and guaranteed pay; a high hourly rate without guaranteed hours says little about monthly income.

4. Check probation and earlier employment

Find the written probation clause and compare it with contract duration and earlier duties for the same or a successor employer. A new signature does not automatically permit new probation. Resolve doubts before resigning from your current job. Our probation guide covers the specific conditions; this checklist does not approve a clause.

5. Flag restrictions and missing agreements

Flag non-compete and client restrictions, training costs, penalties, outside work and variation clauses. Ask about scope, costs and exceptions. Use existing guides for training costs and post-employment restrictions. Signing does not make every clause valid; equally, do not assume you may ignore it without assessment.

6. Prepare questions and keep the final version

For each unclear point, note the current wording, your question and desired clarification. Ensure agreed changes appear in final documents and keep your own copy. Ask for time before signing if needed; do not assume a general statutory cooling-off period afterwards. Use a union, legal expenses insurer or our help request route for review; nothing is sent automatically to your employer.

Can employment exist without a signature?

An employment agreement can also be oral. Written records help with evidence, but no signature does not prove there is no employment relationship. Request missing terms and obtain advice about any dispute.

Record what happened, when, the response and where to find the letter, message or photo. Mark uncertain dates.

Is my evidence sent?

No. You only note where it is kept. No files are uploaded or sent automatically.

How do I save my timeline?

Your entries are not saved automatically. Choose Save and continue later to store this preparation, including your timeline, in My overview. Wait for confirmation and save new changes again. You can also download a Word file without an account.

For each event, note the date, what happened and where the evidence is kept. Example: 3 October — letter received — correspondence folder.

Describe the solution you would like, such as an explanation of a deduction and repayment of the outstanding amount.

For example: which document is missing, who can provide it and what should I do first?

Record the date and its source. If unknown, note this and check promptly. This tool does not calculate or monitor deadlines.

After your conversation

These are your own notes. Confirm agreements with the other person; these notes do not prove their agreement.

This is your preparation, not a submitted request, objection or legally reviewed document. A tick records only your own progress. Check the procedure and deadline in the original letter.
