Check a home purchase contract before signing
What would you like help with?
Detailed explanation, checklist and sources
For a private buyer of a Dutch home, not every purchase contract. Check terms before signing; a contract called ‘preliminary’ is not necessarily non-binding.

1. Identify the purchase
Record existing or new construction, seller, buyers, home and included items. Land, houseboats, business purchases and auctions follow different rules; this is not automatic approval. For a new build, examine the construction agreement as well as the land purchase: specification, completion, instalments, construction interest, conditions and special use/appearance requirements with penalties. A model contract is not personal approval. Link staged payments to agreed progress. Verify an actual warranty certificate, provider, coverage, exclusions and completion protection on insolvency; marketing is not a certificate. 'Vrij op naam' concerns agreed transfer costs; mortgage deed and advice may be extra. A project notary often handles transfer, but you need not automatically use that notary for the mortgage deed. An apartment right combines co-ownership of the building with defined use. Obtain the division deed and drawing from Kadaster, applicable model regulations and year, deed deviations and house rules. Clarify private/common areas and alteration/letting rules. You join the VvE: request budget, accounts, recent minutes, reserve fund, maintenance plan and planned extra contributions. Charges may include heating, insurance and cleaning as well as maintenance. The board implements and the meeting decides under applicable voting rules; a ground-floor home may contribute to the roof. Do not assume one universal voting threshold or unlimited house-rule powers. Erfpacht is a property use right, not automatic land ownership. A linked superficies right can separate building and land ownership; check termination and possible compensation. Read the grant deed and general conditions: owner, duration, renewal, current ground rent, redemption, indexation/revision, use, upkeep, termination and transfer consent. Scheme names do not explain all rights. Before signing ask the lender about financeability and any leasehold opinion, especially private rights predating2013. Newer rights and public-owner leasehold depend on lender policy; even a green opinion is no personal credit commitment. Secure suitable financing conditions and assess ground-rent taxation separately. Investigate visible warning signs and survey scope before signing, including crawlspace access and inspection, and check alterations with the municipality. For joint buying record contributions, ownership, mortgage payments and separation/death arrangements through appropriate agreements and, where needed, a will; marriage or partnership does not alone determine every ownership outcome. The notary checks authority, title, mortgages and obstacles, safeguards payment through the client account and arranges transfer deed and registration. The purchase agreement alone does not make you owner. Check the settlement statement, transfer and any mortgage deed, paying only through verified instructions. Use the separate existing costs, tax and defects guidance; possible liability does not automatically award compensation.
2. Check price and transfer
Read price, allocated costs, transfer date, deposit or bank guarantee and payment instructions. Clarify doubts with the agent or notary before payment. The purchase contract is not the notarised ownership transfer.
3. Review conditions
A financing condition is not automatic. Record amount, deadline, evidence and notice method. Check inspection conditions equally carefully. Our existing financing-condition page covers invoking it.
4. Record receipt and deadlines
The statutory home-purchase cooling-off period runs for three days from the day after receipt of the signed agreement; at least two must not be Saturday, Sunday or recognised holidays. Have the end checked. Longer is allowed, shorter is not. Termination and contractual conditions have separate routes.
5. Check risks and annexes
Read questionnaire, items list, ownership or leasehold information, owners’ association documents where relevant, defects, special clauses and penalties. Ask about non-occupancy, age and indemnity clauses; effect depends on wording and facts.
6. Seek review before committing
Prepare your own questions and documents; resolve omissions before signing. Seek expert help immediately for an active deadline. Use the existing termination page to withdraw from purchase; this preparation neither generates nor sends a contract.
