May the police search my clothing or body in the Netherlands?
Not without a legal basis. Dutch police may search a person during a criminal investigation, for safety, or preventively in a designated security-risk area. The applicable power depends on the circumstances.

1. Ask which type of search is being used
This page concerns the European Netherlands. A clothing search, body search, safety search and preventive weapons search are different powers with different conditions. Calmly ask for the reason and legal basis and whether you have been arrested.

2. Check your position in the investigation
In a criminal investigation, a search may be used to find objects relevant to the case. A more intrusive examination of the body has stricter decision-making rules. The word ‘check’ alone therefore does not establish what was permitted.
3. Check a preventive weapons search
A preventive weapons search can take place without personal suspicion, but only in a designated security-risk area and during an order issued by the public prosecutor. The order states the supporting facts, area and times. Ask where the designation or order was published if this is the reason given.
4. Record the search and any seizure
Do not physically resist. As soon as possible, record the place, time, names or service numbers, stated reason, what was searched and who was present. If an item was taken, ask what was seized and request written proof or a case number.
5. Use your rights after arrest
If you were arrested as a suspect, your rights include being told the suspected offence, the right to remain silent, and consultation with and assistance from a lawyer during questioning. Report language difficulties, medical problems and necessary medication immediately. A search does not remove these rights.
6. Choose the correct follow-up route
A complaint about an officer’s conduct is submitted to the police. The lawfulness and consequences of an investigative measure may also be addressed in the criminal case; discuss this promptly with a criminal lawyer. Follow deadlines in letters or decisions and do not wait for the conduct complaint.
How can I make a useful short record of the search?
Draft note: ‘On [date/time], at [place], I was searched by [name/function]. The reason given was [reason]. They searched [factual description], and [no/an] item was taken. I would like to know which power was used and receive the case or registration number.’ Add facts only and keep it with your documents; this website sends nothing.

For each event, note the date, what happened and where the evidence is kept. Example: 3 October — letter received — correspondence folder.
Describe the solution you would like, such as an explanation of a deduction and repayment of the outstanding amount.
For example: which document is missing, who can provide it and what should I do first?
Record the date and its source. If unknown, note this and check promptly. This tool does not calculate or monitor deadlines.
After your conversation
These are your own notes. Confirm agreements with the other person; these notes do not prove their agreement.
This is your preparation, not a submitted request, objection or legally reviewed document. A tick records only your own progress. Check the procedure and deadline in the original letter.
