May a Dutch BOA arrest me?

Detailed explanation, checklist and sources

A Dutch special investigating officer (BOA) may arrest a suspect. Whether the arrest was allowed in your case depends on the alleged offence, the officer’s domain and duties, the suspicion and how the arrest was carried out.

On this page

1. Identify the officer and role

This page concerns BOAs in the European Netherlands. A supervisor enforces administrative rules; a BOA investigates designated criminal offences. One person may have both roles. Ask for the organisation, function, BOA insignia or identification and the role in which the person acted.

2. Distinguish stopping from arrest

Stopping a suspect briefly serves to establish identity. Arrest deprives a person of liberty for further criminal processing. Clearly ask whether you are free to leave. Do not physically resist, and afterwards record exactly what was said and done.

3. Check duties, domain and suspicion

Justis states that BOAs may arrest suspects. The offences a BOA may investigate are nevertheless limited by the domain and duties, and the employer determines which powers are actually used. Record the alleged offence and why you were considered a suspect.

4. Check transfer and measures used

Arrest does not automatically give every BOA the same force or search powers. Some BOAs have additional police powers or force equipment under conditions. Record handcuffs, force, searches, injuries and witnesses separately, and ask when and to whom you were transferred.

5. Use your rights as a suspect

After arrest, a suspect has the right to know the suspected offence, the right to remain silent, confidential consultation with a lawyer before questioning and assistance during questioning. Immediately request an interpreter, doctor or necessary medicines when needed. Ask your lawyer about lawfulness and duration.

6. Separate complaint, fine and criminal case

A complaint about a BOA’s conduct is generally submitted to the employer. Challenge a fine or decision using the remedy stated in that document; a complaint does not replace it. The criminal case and lawfulness of arrest require separate assessment. Record every deadline immediately. The employer must register complaints and apply a complaints procedure. The supervising public prosecutor and direct supervisor monitor BOA work, but that does not automatically make them the desk for your conduct complaint. Identify the employer and follow its complaints procedure, separately from any legal remedy in your own case.

Which facts should I put in my timeline?

Draft timeline: ‘On [date/time], [organisation/function] approached me at [place]. I was told I was [stopped/arrested] for [alleged offence]. Then [factual steps] occurred, with [no/use of] handcuffs, search or force. At [time], I was [released/transferred].’ Add documents and witnesses without yet drawing a legal conclusion.
