May the police ask for my identity document in the Netherlands?

Dutch police may not request your identity document without a reason. The officer must reasonably need your identity for a police task, for example because of an offence, accident, investigation or specific public nuisance.

1. Check who is speaking to you

This guidance concerns identity checks by Dutch police. Police officers, supervisors, special enforcement officers, conductors and private security guards do not automatically have the same task or powers. Calmly ask the person’s role and whether they can show official identification.

2. Ask for the reason

An officer may request identification when your identity is reasonably necessary for carrying out a police task. You need not be a suspect; a possible witness or person involved in an accident may also be checked. A general wish to check everyone is not itself an explanation: the specific circumstances matter.

3. Show a valid original

If the request is authorised, show a valid original identity document. A photograph or copy on your phone is not a valid identity document. A driving licence often works, but not in every statutory setting. Do not surrender the document longer than necessary and ask what happens if details are recorded.

4. Record the check carefully

As soon as possible, record the date, time, place, stated reason, vehicle or service number, name or identification details and witnesses. Keep any fine, official report, receipt and messages. Separate observed facts and exact words from your legal conclusion.

5. Avoid escalation on the street

Refusing an authorised request may have consequences. Do not physically resist or obstruct the check. Calmly say that you want to understand the reason and will have any objection reviewed later. Call 112 for immediate danger and use the regular police channels otherwise.

6. Choose the correct next route

A complaint about conduct goes to the police unit concerned. A fine, punishment order or other decision must be challenged through its own remedy and within the deadline stated on the document; a complaint does not stop that deadline. Have the reason, power and documents reviewed together if in doubt.

What short note can I make immediately after the check?

Write: ‘On [date/time], [officer name/number] asked for my identity document at [place]. The stated reason was: [words]. According to the officer I was [role]. I showed [document]. Then [factual sequence] happened. Witnesses were [names]. I received [document/no document].’ Include only confirmed facts; the site sends nothing.
