Can I challenge my neighbour's environmental permit?

Detailed explanation, checklist and sources

Immediately obtain the decision, drawings and appeal instructions. The correct route depends on the procedure, not simply on whether you already wrote a letter. Protect deadlines while discussing matters with your neighbour.

1. Find the application and decision

Check official electronic notices and request the complete file, dispatch date and procedure type from the municipality. An application notice is not an issued permit. Use the Omgevingsloket to check activities and local rules; technical construction and planning aspects may need separate permissions. Applications predating 1 January 2024 may follow transitional law.

2. Choose the correct procedure

In the regular procedure, an interested party generally has six weeks to object to the authority, starting the day after proper notification, commonly dispatch to the applicant. A court appeal may follow the objection decision. In the extended procedure, a draft is first available for six weeks for comments, followed by direct appeal against the final decision. An earlier informal response does not remove the regular objection stage.

3. Explain your interest and grounds

Explain direct effects on you: distance, view, daylight, privacy, noise or safety, with photographs and drawings. Disliking the appearance does not give a veto. Connect each ground to the relevant rules and decision-making discretion. Departure from the local environmental plan is not automatically prohibited: permission may be granted following the required assessment. A private ownership dispute is different from challenging a permit.

4. Submit demonstrably in time

Include name, address, date, decision reference, specific grounds and signature, using the authorised submission channel stated in the decision. Keep acknowledgement. If time is short, seek immediate advice about a timely provisional objection and a deadline for additional grounds; do not wait for the file. Ordinary email or conversation is not automatically a valid objection. Recheck the deadline and court for any appeal.

5. Arrange separate urgent protection

Objection or appeal normally does not suspend the permit. Check its actual commencement date: certain irreversible activities have a four-week delay, during which an interim-relief application may prevent commencement until decided; urgent exceptions exist. If construction or demolition is imminent, promptly seek advice about interim relief, urgency and a pending objection or appeal. Court fees apply; a lawyer is not compulsory. Success is not guaranteed.

6. Distinguish enforcement and private rights

For work without a required permit or contrary to conditions, submit a reasoned enforcement request to the competent authority. Permit-free does not mean rule-free; without an appealable permit decision, a permit objection is not the route. Request a formal decision and check its applicable decision deadline and extensions before issuing a default notice. Nuisance, damage, boundaries and access to your land may also require agreements, mediation or separate civil assessment.

Draft letter — complete yourself

Check facts and recipient. The requested response date is not automatically a statutory deadline; keep proof of sending.

Does my objection automatically stop the work?

Usually not. Check commencement and seek legal help for interim relief if urgent. The special four-week rule for some irreversible activities is not a general waiting period for every permit.
