What can I do if the IND decides too late?
What would you like help with?
Detailed explanation, checklist and sources
First check whether the statutory decision period, including any valid extension, has truly expired. You may then formally put the IND in default and give it two weeks to decide.
On this page
1. Find the correct decision period
The period differs by Dutch residence application or objection. Check the receipt, My IND and the official decision-period page. Record procedure, start and end date.
2. Check extension or suspension
IND can extend the period in defined cases or missing information can affect it. IND must notify an extension. Collect that letter before calculating expiry.
3. Validly put IND in default
If the period has expired without a decision, use official form 9001. Send it by the post or secure-email route on the form; another channel may be invalid. Add any required authorisation.
4. Keep proof and wait two weeks
Keep sending and receipt proof and note when IND received the notice. IND then has two weeks to decide. Track the case and new correspondence.
5. Appeal to court if needed
If IND has not decided within two weeks after receiving a valid notice of default, you may bring an appeal for failure to decide before the competent court. The court can order IND to decide within a reasonable period. Since 16 October 2026, the amended Aliens Act rules exclude a judicial penalty in this procedure. Transitional rules apply if IND was already overdue before that date and you had already filed the failure-to-decide appeal before that date: the old rules continue for that appeal. An earlier application or notice of default alone is insufficient. Keep evidence of the appeal filing date and ask your lawyer to assess the applicable rules and any existing court order.

6. Do not expect an automatic administrative penalty
For covered IND cases, a default notice dated 15 April 2025 or later no longer creates an administrative penalty. The notice remains required before this court appeal. Seek help if the period or route is unclear.
How do I make an IND timeline?
List receipt, original deadline, every extension or suspension, revised deadline, sending and receipt of the default notice, end of two weeks and any appeal date. Link each date to evidence. This site sends nothing.

For each event, note the date, what happened and where the evidence is kept. Example: 3 October — letter received — correspondence folder.
Describe the solution you would like, such as an explanation of a deduction and repayment of the outstanding amount.
For example: which document is missing, who can provide it and what should I do first?
