IND decision received: object or appeal in the Netherlands?

An IND refusal can affect your residence, work or family. Start with the decision: which application was assessed, why was it refused and what next step does the letter describe? Use this guide to prepare a focused conversation with a legal adviser.

1. Identify the procedure

A regular residence refusal normally requires an objection first; an asylum refusal goes directly to appeal. Read the decision for your deadline and permission to await the procedure in the Netherlands. Also record when the letter arrived. Do not borrow a deadline from a different type of case. Keep the complete decision, attachments and envelope together.

2. Organise the reasons and your evidence

Make three columns for yourself: the refusal reason, what you think is wrong, and the document supporting your position. Put events in date order. Separate missing documents from disputed facts. Ask an immigration lawyer which points matter and how to submit your response in time. Keep a copy and proof of sending or receipt.

3. Discuss residence and urgency separately

Interim relief is a separate urgent court procedure alongside an objection or appeal. Discuss it immediately if you cannot remain. Explain exactly what may happen and when. Agree who will take each step, how you can be contacted, and what fees and language support apply. Record the arrangement instead of assuming someone is already handling the case.
