How do I request a non-appeal certificate after a Dutch divorce?
What would you like help with?
Detailed explanation, checklist and sources
A certificate of non-appeal records that the divorce has not been appealed. You may need it for municipal registration. The judgment alone does not yet dissolve the marriage.

1. Municipal document list
Ask the municipality which documents it requires to register the divorce. Usually these include consent accepting the judgment or a non-appeal certificate. The marriage ends only on registration.
2. Acceptance and consequences
If the appeal period is still running and both parties want to proceed, discuss an acceptance document with your lawyer. It states agreement and no appeal; do not sign without understanding the consequences.
3. Appeal deadline
After the three-month appeal period, normally request non-appeal from the court that granted the divorce. Have your own deadline's start and end checked rather than relying on a general date.
4. Court or appeal court
If an appeal concerns ancillary matters such as maintenance but not the divorce itself, the appeal court may issue the certificate under conditions. Ask your lawyer to establish the correct route.
5. Case, decision and fee
Follow the court's instructions and prepare the case number and decision. Divorce certificates carry no court fee; other civil cases usually do. You may receive a stamp or a separate statement.
6. Registration confirmation
Send the required registration documents to the municipality where you married and obtain confirmation. Ask your lawyer to monitor the registration deadline. Our checklist requests and registers nothing. The request for registration must be made no later than six months after the day the divorce decision becomes final; otherwise the decision loses effect. Do not automatically count from the judgment or certificate date. Have your lawyer determine finality, including where an appeal concerns only ancillary matters, and retain proof of the timely registration request.

Am I divorced when the judge gives the decision?
No. Dissolution requires registration of the divorce decision in the civil register. Arrange the required documents and have the applicable registration deadline monitored.
