How does adoption or revocation work in a Dutch court?

Detailed explanation, checklist and sources
Adoption creates legal parenthood and changes family ties. First distinguish domestic adoption, recognition of a foreign decision and revocation; their conditions differ.

1. Identify the route
Legal parenthood differs from biology and parental responsibility; a child has at most two legal parents. A married/registered female partner may already be a legal mother where the donor is legally unknown; otherwise recognition or adoption may be relevant. Foreign adoptions may qualify for automatic recognition: assess the decision, treaty status and recognition conditions, not just country. Intercountry adoption is being phased out towards end-2030; licensed agencies must submit matching proposals before 1 May 2030, with possible later completion by the Central Authority. Fiom has taken no new registrations since 21 May 2024. The current Fiom guidance and February 2026 government letter describe a Central Authority route while the current law applies, but discourages starting and promises no success. Ask about your status, country and any future sibling policy.

2. Check domestic requirements
For a child habitually resident in the Netherlands, the ordinary requirements include minority at filing, an adult adopter at least eighteen years older who is not a grandparent, and clear benefit to the child. Couples normally need three years' cohabitation and one year's joint care; marriage is unnecessary. A single adopter needs one year's care; a new partner normally three years with the parent and one year caring together. Female co-mothers have exceptions and may apply before birth: check timing and existing parenthood. The judge examines what the original parent can still provide as a parent, authority and objections. Step-parent adoption preserves the partner-parent's tie. Joint parental responsibility may offer an alternative without the same change of parentage. For an adult, exceptional case law may be relevant: obtain a separate assessment. The 2026 reform proposal does not establish that expanded adoption or revocation rules already apply.

3. Prepare with a lawyer
A lawyer must file the reasoned petition. Gather birth/authority details, cohabitation and care evidence, original parents' details and contact, relevant donor information, earlier decisions and foreign documents with necessary translation/legalisation. Let the lawyer identify exact evidence, competent court and exceptions. Agree lawyer, court and document costs; pay according to the court invoice. Legal aid and municipal special assistance may be available depending on income and assets.
4. Respond and prepare the child interview
The judge identifies and informs interested parties. Written defence requires a lawyer; oral-only defence at the hearing does not. Agreement uses the supplied form acknowledging receipt, no defence and no need for a hearing. Silence means consideration without your input, not automatic consent. A hearing may be omitted if conditions and consent are clear and the judge has no questions; otherwise it is private. Children from eight are invited to speak without parents, sometimes younger children too. This is distinct from the statutory objection threshold at twelve; younger children able to understand consequences may also count. A parental objection can be overridden only under legal exceptions, not a private agreement.
5. Keep the decision and appeal deadlines
The written decision often follows about four weeks after consideration, but the whole case may take three months to over a year. The judge assesses the child's interests and all conditions; filing does not guarantee adoption. Discuss effective date, civil-registration processing and name, responsibility, family and inheritance effects with the lawyer. Appeal requires a lawyer within three months of the decision; cassation against the appeal judgment also has a three-month period and requires a lawyer. In international cases check recognition abroad too. Keep certified records and use the separate legalisation/apostille route where needed.
6. Assess revocation separately
Only the adopted person can request revocation, not biological or adoptive parents. The ordinary statutory age window is twenty, twenty-one or twenty-two. At another age seek prompt advice about exceptional possibilities, not a guaranteed solution. A lawyer files the reasoned petition and the judge assesses your interests. Adoptive parents may be interested parties using the same written/oral response routes. Revocation ends legal ties with adoptive parents and restores those with original legal parents. Discuss personal, name and property consequences before filing.
Does an interested party always need a lawyer to respond?
A written defence requires one. Oral-only defence at the hearing does not, nor does the supplied agreement form. Starting an adoption or revocation case does require a lawyer.
