Detailed explanation, checklist and sources

Apply to the court for beschermingsbewind when someone cannot properly manage money and assets. Prepare the reason, applicant and proposed administrator. This is different from debt restructuring.

1. Choose the appropriate support

Administration may address problematic debts/overspending or a physical/mental condition. It protects an adult's money and assets; it does not automatically cancel debts. Care decisions may require mentorschap. Compare the official support options before requesting a measure.

2. Check who may apply

You may apply for yourself; a partner or blood relative up to the fourth degree may also apply, for example. Check the official list. Propose a private or professional administrator. The court decides suitability and scope; the family does not make the final appointment.

3. Collect relevant documents

Collect willingness statements, relevant consent statements and supporting evidence. For debts, list debts and income; for health, supply appropriate signed information. Include an existing advance directive concerning representation. A partner's disagreement does not automatically prevent applying: explain it. Do not share medical records in general chat. You may prepare and apply from three months before the eighteenth birthday. Debt/wastefulness administration is ordered for a fixed term; physical/mental grounds may be temporary or indefinite. An existing power of attorney or living will does not exclude administration, for example with missing authority or poor management. Limited administration may cover just a home, inheritance or account; subsequent sale or estate action may also need judicial authorisation. Add ownership/Kadaster records, inheritance evidence or account proof. Two proposed administrators each need a willingness declaration and have equal rank. Simultaneously applying for administration and mentorship incurs one court fee; adding mentorship later incurs another. Institutions add KVK evidence and authority where needed; professionals a plan. Apply to the court of the subject's residence. If invited, applicant, subject and proposed representatives must attend; report inability immediately. Other invited interested persons may attend but need not. Additional support requires permission; the meeting is not open to all. An interested person may object orally or in writing with case number, reasons, evidence, date and signature. Administration starts the day after the decision is sent unless the judge specifies otherwise; appointment does not authorise every transaction.

4. Use the official application

Apply yourself through Mijn CBM or send/deliver the current official form to the appropriate court. Follow the attachment list. A lawyer is not compulsory for the first application. Court fees and possible administration costs apply; check current rates. Our checklist does not replace the form.

5. Prepare for assessment

Record what is going wrong, what support exists and why less intrusive help is insufficient. Follow a hearing/interview summons; contact the court if you cannot attend. Sometimes the court decides on documents. Processing targets do not guarantee appointment or urgent treatment.

6. Read the decision and next steps

Check who is appointed, which assets are covered and the start date. Seek legal help promptly if refused or dissatisfied. Rechtspraak states an appeal within three months of the decision, with a compulsory lawyer; have your own deadline checked. Our assistance request is not a court application or appeal.

Does protective administration erase my debts?

No. It supports money management. A debt arrangement or Wsnp has separate procedures and conditions. Discuss both forms of support if needed; our preparation submits nothing.
