Can I object to a CAK decision?

Detailed explanation, checklist and sources

Yes, if the CAK letter contains a decision open to objection. Object within six weeks and first check whether an objection, a contribution-adjustment request or a report of incorrect care data is the right route.

1. Check the decision and the correct route

This guidance concerns CAK decisions under Dutch administrative law. Check whether the letter itself allows an objection. For an incorrect contribution, an adjustment request or correction of care data may be quicker; if you dispute enrolment in the administrative health-premium scheme, CAK says you must contact the health insurer rather than CAK.

2. Calculate the objection deadline

CAK states a six-week period starting on the day after the date of the decision letter. Record the date, reference and final day. Do not wait for a call or missing document if the deadline may expire; submit a timely provisional objection if necessary and supplement it later.

3. Explain what is wrong

For each part, identify the incorrect data, period or calculation and the outcome you seek. Separate disputes about the contribution amount, income or asset data, the care period and the payment method. A complaint about service does not replace an objection to the decision.

4. Add the required details and evidence

Include name and address, sending date, decision date and reference, reasons, telephone number and signature. Add a copy of the decision and only relevant evidence. Use Mijn CAK, the official form or the postal route in CAK’s instructions and keep proof of submission or receipt.

5. Continue payments and prepare the review

An objection does not generally suspend a decision automatically. Keep checking invoices and payment arrangements and ask CAK separately what must be paid during the objection. CAK may request clarification or offer a hearing; retain all additional documents and responses.

6. Check the decision on objection

CAK describes a usual handling period of twelve to eighteen weeks from the date of the original decision and may ask for more time. The decision on objection states whether and where court appeal is possible. A request through this website does not lodge an objection or appeal and stops no deadline.

What structure can I use for my CAK objection?

Draft: ‘I object to CAK’s decision dated [date], reference [reference]. I believe [part/period] is incorrect because [factual reason]. [Evidence] shows [relevant fact]. I ask CAK to [specific outcome].’ Add the required details and signature and check the instructions in your own decision. This website sends nothing.
