Fine for breach of the duty to provide information: how do you respond?
What would you like help with?
Detailed explanation, checklist and sources
Have you received a letter about information that was not reported, or was reported late, in connection with a Dutch benefit? Check whether it is a notice of intended fine or a final fine decision. Support your response with the facts and your circumstances. The information below mainly concerns the UWV route; for another authority, follow its own letter and rules.

1. Determine which document you are responding to
UWV first sends a letter about a possible fine together with a report of its findings. According to UWV, you have two weeks to respond. This is a different step from objecting to the later final decision. Note the response date in the letter and request clarification immediately if anything is unclear, without allowing the deadline to expire.
2. Check which information was missing
Compare the report with what you were required to report and with your earlier messages. Keep acknowledgements of receipt and note the date, channel and content of your report. Also check whether UWV already had the information and what the reporting duty was in this situation. Do not accept an alleged violation without scrutiny, but do provide an accurate, factual explanation. You must be able to identify incorrect assumptions with evidence.
3. Explain your circumstances
Describe what happened and why, for example which instruction you received or which circumstances prevented timely reporting. UWV takes the situation and circumstances into account when determining the fine. A correction you made yourself before UWV discovered the error may be relevant, but does not automatically result in the fine being waived. If necessary, seek targeted help in assessing culpability and the amount.
4. Reassess the final decision
After your response, UWV makes a final decision on the fine. If you disagree, check the objection route and deadline: at UWV, generally six weeks. Refer to your earlier response and explain which points have still been assessed incorrectly. If grounds or documents are missing, secure the deadline in time through the official route. Your response to the intended decision does not replace an objection against the final decision.
5. Keep the fine and recovery claim separate
A fine may be imposed in addition to a recovery claim. Check the decision, amount and deadline for both. Repayment does not automatically cancel the fine. If you cannot pay, discuss a suitable arrangement and provide your financial circumstances. A payment arrangement likewise does not replace a substantive objection against the fine.
6. Prepare your next step
Keep all letters, evidence and acknowledgements of receipt. Follow the appeal instructions after the decision on your objection if you wish to challenge the outcome. Seek help in time if the deadline is short or the facts are complicated. The checklist and download help you organise your case file. Our own help request does not send a response or objection and does not suspend your deadline.

List events and contacts. Note where you keep the evidence; no upload is needed.
What goes in my timeline?
Record what happened, when, the response and where to find the letter, message or photo. Mark uncertain dates.
Is my evidence sent?
No. You only note where it is kept. No files are uploaded or sent automatically.
How do I save my timeline?
Your entries are not saved automatically. Choose Save and continue later to store this preparation, including your timeline, in My overview. Wait for confirmation and save new changes again. You can also download a Word file without an account.

For each event, note the date, what happened and where the evidence is kept. Example: 3 October — letter received — correspondence folder.
Describe the solution you would like, such as an explanation of a deduction and repayment of the outstanding amount.
For example: which document is missing, who can provide it and what should I do first?
Record the date and its source. If unknown, note this and check promptly. This tool does not calculate or monitor deadlines.
After your conversation
These are your own notes. Confirm agreements with the other person; these notes do not prove their agreement.
This is your preparation, not a submitted request, objection or legally reviewed document. A tick records only your own progress. Check the procedure and deadline in the original letter.

Frequently asked questions
Is responding to the intended decision the same as lodging an objection?
No. You respond before the final fine decision. If you wish to challenge that later decision, you must again follow the objection route stated in it.
Does the fine disappear if I repay the benefits?
Not automatically. The recovery claim and fine are separate components. Have both assessed and keep track of both deadlines.
Will I always receive a fine for reporting late?
Not automatically. The reporting duty, facts and circumstances must be assessed. Sometimes a warning or adjusted fine may be appropriate; your situation determines what is possible.
