Repaying benefits: is the recovery claim correct?

Detailed explanation, checklist and sources

Do you have to repay benefits in the Netherlands? Check the reason, period and calculation. If you disagree with the decision, keep track of the objection deadline. If you cannot pay the amount, also discuss debt collection. This page mainly covers UWV; for municipal benefits, follow your municipality's instructions.

1. Check exactly what is being claimed back

A recovery claim may result from an advance payment that was too high, a change that has not yet been processed, or payment after entitlement ended. This does not automatically mean that you will receive a fine. Request the calculation and compare, for each month, the amount received, the amount to which you were entitled according to the decision, and previous repayments or offsets.

2. Compare your reports with the case file

Keep payslips, bank statements and evidence of changes you reported. Note when and through which channel you reported something. For each disputed point, set out what the authority assumes, what you believe is different, and which document supports this. Merely stating that you have already spent the money does not explain why the calculation would be incorrect.

3. Distinguish between gross, net and separate decisions

At UWV, whether repayment is gross or net depends, among other things, on the year in which you received the benefit and the year of repayment. Therefore, request an itemisation if the claim is higher than the amount you received net. A decision on entitlement to benefits, the recovery claim and any fine may need to be challenged separately. Check every document and every deadline; one response does not automatically cover everything.

4. Lodge an objection against an incorrect decision in time

At UWV, the deadline is generally six weeks; check the letter. Request missing documents without allowing the deadline to expire. If your grounds are not ready yet, you can submit a pro forma objection to UWV in time with the other required information and add the grounds later within the specified deadline. State precisely which decision you dispute. Sign a letter and keep the acknowledgement of receipt.

5. Discuss an affordable solution at the same time

An objection does not automatically suspend the UWV decision. Contact UWV quickly if you cannot pay in one lump sum and ask about an arrangement or suitable solution. UWV may offset the debt against ongoing benefits; check the letter and the calculation of what you must be left with. Report errors in the financial information used immediately. A payment arrangement does not change an incorrect recovery claim: the substantive objection route remains necessary for that.

6. Keep track of arrangements and next steps

Keep proof of payment and written agreements, and check the current balance. If your income changes, discuss in time whether the arrangement is still feasible. In the event of serious financial problems, municipal debt assistance may provide support. Follow the appeal instructions after the decision on your objection. Use the checklist and Word download for preparation; our own help request does not submit an objection and does not monitor your deadline.

Your timeline and evidence

List events and contacts. Note where you keep the evidence; no upload is needed.

What goes in my timeline?

Record what happened, when, the response and where to find the letter, message or photo. Mark uncertain dates.

Is my evidence sent?

No. You only note where it is kept. No files are uploaded or sent automatically.

How do I save my timeline?

Your entries are not saved automatically. Choose Save and continue later to store this preparation, including your timeline, in My overview. Wait for confirmation and save new changes again. You can also download a Word file without an account.

Up to 20 events. Choose a different position for an event to change the order.

0 / 6 · Checked or collected

For each event, note the date, what happened and where the evidence is kept. Example: 3 October — letter received — correspondence folder.

Describe the solution you would like, such as an explanation of a deduction and repayment of the outstanding amount.

For example: which document is missing, who can provide it and what should I do first?

Record the date and its source. If unknown, note this and check promptly. This tool does not calculate or monitor deadlines.

After your conversation

These are your own notes. Confirm agreements with the other person; these notes do not prove their agreement.

This is your preparation, not a submitted request, objection or legally reviewed document. A tick records only your own progress. Check the procedure and deadline in the original letter.

Frequently asked questions

Is repayment the same as a fine?

No. Repayment corrects an overpayment; a fine is a separate sanction. Check both decisions if you receive both.

Does debt collection automatically stop because of an objection?

Not automatically at UWV. Discuss payment problems separately and have the appropriate step assessed urgently if necessary.

Why is UWV claiming back more than I received net?

The calculation may include a gross amount, depending on the years of receipt and repayment. Request the itemisation and have the consequences for your tax return assessed.
