How do I respond to a court petition?

What would you like help with?

Detailed explanation, checklist and sources

Read the petition, your role and the court’s letter immediately. You may defend, consent or not respond, but the consequences differ. Whether you need a lawyer depends on the subject and on responding in writing or orally.

On this page

1. Read the petition and notice

Record court, case number, applicant, requested orders, your interest and response/hearing dates. Compare attachments with your records. A petition differs from a summons or administrative objection. Silence normally does not stop proceedings: the court decides without your response. Consent or a no-objection declaration may speed the decision and remove the need for a hearing; sign only what you understand.

2. Check lawyer requirements

A lawyer is not compulsory for responding at the subdistrict court, for example dismissal, or to protective administration, mentorship or adult guardianship. Written defence to divorce, dissolution of partnership or maintenance requires a lawyer. For contact/care, parental authority, declaration of majority, guardian appointment and name change, written defence requires a lawyer but oral response does not. Parentage, adoption and substitute travel consent depend on your response; substitute child-ID consent, child supervision and out-of-home placement are listed without mandatory counsel. Always check the specific procedure. General civil rule: written defence and written consent through a lawyer; oral response may be personal.

3. Build your response

Explain agreement/disagreement with each request, reasons, a factual timeline and numbered copies of evidence. Give full names, address and case number. Date, state place and sign; a lawyer or representative signs as required when acting. A counter-petition must directly relate to the original request. Check representation requirements and legal wording beforehand. An unsupported allegation or wish is not evidence.

4. File documents correctly and in time

The general paper subdistrict route requires three copies of defence and attachments to the registry/subdistrict team at the address in the letter. Public guidance specifies evidence ten days before the hearing and preferably defence five working days beforehand. These are not universal deadlines: employment and specific procedures may differ. Follow the notice and current rules; keep receipt evidence. In civil cases the lawyer files and requests any extension; a request is not approval. You cannot first submit documents at the general civil petition hearing. Do not wait until the hearing with evidence.

5. Prepare the hearing

If summoned, you may respond orally where allowed. A court may sometimes decide without a hearing, so an oral opportunity is not guaranteed. The applicant speaks first, you respond and the judge asks questions. Attendance is recommended; follow any specific appearance order. Ordinary civil hearings are generally public; family and child cases private. Witnesses are normally not heard at this hearing. Mediation or settlement may be discussed; a signed court record of agreed terms binds.

6. Check the decision and next steps

The result is a court order, a beschikking. Withdrawal, mediated agreement or settlement can end a case without a substantive ruling. The judge gives the expected date; general guidance mentions about three weeks at subdistrict, four in family and six in other civil cases, but oral decisions and different schedules are possible. You or your representative receive reasons and possibly a costs order. Check immediately whether appeal is available, its starting point and whether enforcement continues. Three months is common, with special exceptions. Appeal and cassation require a lawyer; cassation is also usually three months. Asking us for help files no defence or appeal.

Can I speak at the hearing without a lawyer?

In many petition cases yes, but that does not mean you may validly file written defence or a counter-petition without one. Check the subject and notice; some cases are decided without a hearing.
