How do I respond to a civil summons?

What would you like help with?

Detailed explanation, checklist and sources

Check the court, procedure and date immediately. You can often respond yourself at the subdistrict court; ordinary civil proceedings require a lawyer. Interim proceedings have different rules. Negotiation or merely sending documents does not automatically prevent a decision without your defence.

1. Identify the procedure

Read the sender, claim, interest, costs, court and date. Ordinary monetary claims up to €25,000 usually go to the subdistrict court; tenancy and employment cases may go there regardless of value. Follow the stated procedure and obtain advice if unsure. A prosecution summons is criminal, with different rules. A procedural roll hearing differs from the substantive hearing in interim proceedings.

2. Negotiate while protecting the deadline

If you accept the claim, discuss full payment or instalments with the bailiff or claimant’s lawyer. Obtain written confirmation that proceedings were actually withdrawn; an instalment agreement may coexist with a judgment. For financial difficulty, ask the subdistrict court about its debt officer and municipal assistance. Keep payment evidence and monitor the court date.

3. Respond at the subdistrict court

In ordinary subdistrict proceedings you may reply in writing or orally at the roll hearing. A written reply must arrive by the preceding day. Identify parties, case and contacts, explain each defence and number evidence; date and sign. Post two copies with attachments; after secure email immediately post two signed copies. The official DigiD letter tool makes a PDF but does not send it. Include any counterclaim in the first defence; obtain court permission before bringing in a third party for indemnity. Ask for four weeks’ extension in advance in writing or at the roll hearing; further time requires agreement without unreasonable delay or special/compelling grounds. Check the decision.

4. Arrange a lawyer for ordinary civil proceedings

In ordinary civil-division proceedings, a lawyer files your defence with evidence and any counterclaim. Public guidance states arrival by the day before the roll hearing; ask your lawyer to check current procedure rules and the case. Do not assume routine extension. Parties do not attend this civil roll hearing. A substantive hearing or written exchange follows; new hearing documents normally arrive at least two weeks beforehand. The source gives six weeks for reply/rejoinder, four after a substantive interim judgment; follow the court’s actual direction.

5. Prepare interim proceedings

Interim proceedings discuss the substance immediately. A subdistrict defendant may act personally; in the civil division you may defend orally without a lawyer, but a counterclaim requires one. Evidence and announced counterclaims must reach both court and claimant at least24hours, one working day, before the hearing. Follow the official digital/post route and copy the other party. Documents alone do not replace attendance. Request rescheduling promptly if unavailable; do not assume permission. The judgment is provisional and ordinary proceedings may reach a different outcome.

6. Check the judgment and remedy

The court may require further documents, evidence or a hearing; mediation or a recorded settlement can resolve matters. A signed settlement binds. A judgment gives reasons and may award costs. Failure to respond can lead to default; correction may still be possible before judgment, afterwards opposition may be needed. Obtain immediate advice about the applicable deadline and trigger; four weeks is common for opposition, not a safe period from whenever you read the decision. Ordinary civil appeal is usually three months, interim appeal four weeks; exceptions and access vary. Obtain legal help promptly.

7. How soon is the hearing, and can it be postponed?

There is no fixed waiting period: the judge sets the hearing date taking urgency and reported unavailable dates into account. It may take place within days or weeks; follow the date in your summons. Normally at least seven clear days separate service and the hearing, but the judge may shorten this period. Judgment usually follows two weeks after the hearing, sooner in particularly urgent cases. A deadline set by the other party is not automatically a court deadline. If your lawyer stops acting, promptly seek a replacement and, if necessary, request rescheduling with reasons. Searching does not automatically suspend anything. Rescheduling requires a joint request, compelling reasons or the claimant's failure to report your unavailable dates; the judge decides. Apply promptly and no later than 24 hours before the hearing, supplying known unavailable dates and contact details for all parties. Keep following the existing date until the court confirms a change.

8. Defend yourself or obtain legal help?

Defending yourself as defendant may save lawyer fees and avoid waiting for a lawyer; you explain your account directly. However, you must manage the claims, legal arguments, evidence and deadlines yourself and respond to the other side. Merely seeking dismissal is a defence; an independent civil counterclaim requires a lawyer. Legal assistance is sensible for complex agreements, a home or requested penalty payments. Ask for a cost estimate and discuss subsidised legal aid (toevoeging/pro deo). An existing legal-aid grant does not automatically cover every new case: check coverage and any new personal contribution. Court fees and a possible adverse costs order are separate from the hourly rate. The judge may order payment of some of the other side's costs; lawyer costs are normally assessed under a fixed scale, not automatically their entire bill. A legal-aid grant does not protect you against an adverse costs order.

9. Must I repay legal aid after selling a home with equity?

Yes, this is possible. After the case ends, the Dutch Legal Aid Board assesses its financial result. Your own share of net sale proceeds or a monetary claim from being bought out may count if directly connected with the legal assistance. Merely owning equity is not the same as an established monetary result. The legal-aid grant may be withdrawn retrospectively; compelling circumstances may justify an exception. For a case ending in 2026, the result threshold is €19,239.50: a result equal to or above it normally triggers withdrawal. The Board assesses your personal result, not simply the entire sale price or the combined equity. The applicable standard depends on the year the case ends; current policy does not double it because you are married or cohabiting. A monetary claim may count before payment. Where a sale has been agreed but not completed, the Board may estimate the expected result. Spending the proceeds on another home or furnishings does not automatically prevent assessment. Have the notarial statement, mortgage, allocation, linked policies and evidenced offsets checked. Who receives payment? If the Board has already paid your lawyer, it may recover that subsidy from you. Sometimes the lawyer also issues a supplementary bill up to the normal fee, deducting the legal-aid remuneration. Alternatively, the lawyer bills you directly at the normal rate and nothing is repaid to the Board for that same work. A supplementary commercial bill is not automatic. Request an itemised account crediting personal contributions, subsidy and other payments already made: the same work is not paid in full twice. Agree the rate, VAT and estimated hours in advance; the lawyer should await the final result-assessment decision before charging the normal rate. Several grants and lawyers may be affected where their work directly relates to the same financial result, for example interim proceedings to compel cooperation with a sale. An independent child-contact case is not automatically included. Seek an explanation for each grant and reserve proceeds if necessary. Respond to an intended withdrawal within the letter’s deadline, substantiate compelling circumstances and protect the objection procedure after a final decision; public guidance states six weeks after dispatch. A phone call does not replace a timely objection.

Can I have to pay both the government and my lawyer from equity?

That is possible after withdrawal, but not two full charges for the same work. The Board may recover its paid subsidy and the lawyer may supplement it up to the normal fee, with credits applied. Sometimes only the lawyer invoices you. First have your personal result, the applicable year and each affected grant assessed.
