Detailed explanation, checklist and sources

First ask the bank or institution whether it needs a verklaring van erfrecht. A Dutch civil-law notary establishes the heirs and who may administer the estate. Documents, costs and timing depend on the estate and the investigation.

1. Ask who requires the certificate

In the Netherlands, a certificate of inheritance is not compulsory after every death. Ask the bank or institution what it requires for this particular estate. Have the need confirmed before commissioning a notary. Sometimes other evidence, such as a death certificate, is sufficient; the institution decides what it accepts for its own process.

2. Understand the notary’s investigation

The certificate identifies the heirs and those authorised to act for them. The notary examines registers and any will. A will alone may not establish the current position: heirs may have died or rejected the inheritance. If another country is involved, ask which additional checks are necessary rather than assuming Dutch procedures cover everything.

3. Prepare the relevant information

Gather death details, known family relationships and contact details of heirs. Bring the bank’s request. Mention an executor, minors, protective administration, disputes or overseas information. The notary decides which documents and identity checks are needed. This preparation does not require uploading identity documents or private family records.

4. Compare suitable quotations

Fees vary between notaries. Request one or more quotations based on the same actual circumstances. Ask which work is included and what additional investigation could cost. An advertised starting price does not guarantee the final bill. Also establish which information is missing before the investigation can begin.

5. Separate authority from accepting the estate

The certificate does not replace your decision to accept or reject the estate. Have unknown debts assessed before distributing assets. If the bank offers an indemnity instead of requiring a certificate, read its consequences: repayment may be necessary if you later prove not to be authorised, or not solely authorised.

6. Arrange the next step

Investigation can take weeks or months, for example when heirs are difficult to trace. Ask about progress and missing documents, not a guaranteed completion date. For real estate, registration in the Kadaster may be relevant; discuss this with the notary. Keep your preparation locally and use our own help-request route for a dispute.

Is a will the same as a certificate of inheritance?

No. A will records the deceased’s wishes. For the certificate, the notary investigates who the actual heirs are and who may act. First ask whether the bank or institution needs this certificate.
